Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of BookingCue ("the Service"), operated by HM Media LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.
2. Account Registration
Account Types
The Service supports two types of user accounts:
- Company Members — admins, crewers, and employees of AV production companies
- Freelancers — independent crew members available for booking
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at henry@hmmediagroup.com of any unauthorized use.
Accurate Information
You agree to provide accurate, current, and complete information during registration and to keep your information up to date.
3. Closed Beta Access
The Service is currently in closed beta. Access is gated by an access code. We reserve the right to grant, restrict, or revoke access at our sole discretion during the beta period.
4. Use of the Service
Permitted Use
You may use the Service to:
- Create and manage events, phases, and positions (Company Members)
- Build and manage freelancer pools (Company Members)
- Send crew booking communications via the Service (Company Members)
- Receive and respond to booking requests (Freelancers)
- Manage your freelancer profile and availability (Freelancers)
Prohibited Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Send spam, harassment, or unsolicited communications through the Service
- Attempt to access accounts, data, or systems you are not authorized to access
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Scrape, harvest, or otherwise collect information about other users without their consent
- Solicit freelancers belonging to another company's pool with intent to circumvent the platform
- Use the Service to compete directly with HM Media LLC
- Interfere with or disrupt the Service or its infrastructure
5. SMS Communications
Consent
By providing your phone number and opting into SMS messages, you expressly consent to receive SMS messages from BookingCue related to crew booking communications, including outreach requests, confirmations, event notifications, and crew updates.
Message Frequency
Message frequency varies based on event activity. You may receive multiple messages per day during active booking periods.
Message and Data Rates
Message and data rates may apply. Check with your mobile carrier for details.
Opt-Out and Help
- Reply STOP to any SMS message to opt out of further messages
- Reply HELP to any SMS message for assistance
- You may also toggle SMS consent off in your profile settings

SMS Data Privacy
Phone numbers and SMS opt-in data are used solely for crew booking communications and account-related notifications. We do not share, sell, rent, or transfer phone numbers or SMS opt-in data to any third party for marketing purposes.
6. Email Communications
By creating an account, you consent to receive transactional emails related to your use of the Service, including outreach requests, confirmations, rejections, fill notifications, account verification, password resets, and Service updates. You may unsubscribe from non-essential emails at any time.
7. Freelancer Profiles and Portability
Portability
Freelancer profiles are portable across companies. Once you create a freelancer profile, you may join multiple AV production companies' pools without recreating your profile.
Anti-Poaching
Companies cannot view freelancer pools belonging to other companies on the Service. This is enforced at the application level to protect company business relationships.
Profile Accuracy
Freelancers are responsible for keeping their profile information (roles, skills, rates, availability, contact information) accurate and current.
8. Booking and Outreach
No Employment Relationship
The Service is a communication and coordination tool. We do not employ freelancers, do not guarantee bookings, and are not a party to any agreement between Companies and Freelancers. All employment, contractor, payment, and tax arrangements are solely between the Company and the Freelancer.
Response Windows
Outreach requests have configurable response windows. If a freelancer does not respond within the window, the request expires and the system advances to the next freelancer in the queue.
Booking Confirmation
A position is considered filled when a freelancer responds YES to an outreach request. Both parties are notified. Disputes about booking commitments, no-shows, payment, or performance are between the Company and Freelancer.
Double Booking
The Service includes double-booking prevention features but does not guarantee against all scheduling conflicts. Users are responsible for managing their own availability.
9. Fees and Payment
Freelancer Use
Use of the Service is free for freelancers.
Company Subscription
AV production companies pay a subscription fee for use of the Service. Pricing and billing terms will be communicated at the time of subscription. By subscribing, you agree to pay the applicable fees.
Refunds
Refund policies will be communicated at the time of subscription. Generally, fees are non-refundable except as required by law.
10. Intellectual Property
Our Content
The Service, including all software, designs, text, graphics, and content provided by us, is owned by HM Media LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Your Content
You retain ownership of content you submit to the Service (profile information, event details, messages). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display that content as necessary to provide the Service.
11. Termination
By You
You may delete your account at any time by contacting henry@hmmediagroup.com.
By Us
We may suspend or terminate your account at our discretion if you violate these Terms, engage in fraud or abuse, or for any other reason at our sole discretion. We will provide notice when reasonably possible.
Effect of Termination
Upon termination, your right to use the Service ends. We may retain certain information as required by law or for legitimate business purposes (see Privacy Policy).
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
We do not guarantee the accuracy, completeness, or reliability of any communications, freelancer profiles, or event information posted on the Service.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HM MEDIA LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100.
14. Indemnification
You agree to indemnify and hold harmless HM Media LLC and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third-party rights.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Wake County, North Carolina, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HM Media LLC regarding your use of the Service and supersede any prior agreements.
